General Terms and Conditions
Payment Terms
Payment terms are 30 days (with approved credit). Accounts that are 30 days late will be put on credit hold until past due invoices are paid in full.
Freight and Delivery Charges
All deliveries in Los Angeles, Orange, and Ventura counties of the state of California are FREE of charge . All orders outside of the above three counties are subject to freight charges regardless of the dollar amount.
Store and Warehouse Stock
Certain items are not stocked in store; therefore, additional shipping time and charges may be required regardless of order size.
Backorders
Unshipped merchandise from original orders will be shipped when available free of charge.
Returned Goods Policy
Returns are accepted within 10 days from the date of invoice if goods are not used, installed, damaged and are in their original packaging.
Return on Special Orders
NO returns are allowed on special orders.
Claims Buyer
shall examine material upon receipt and prior to installation. All claims for damaged or defective items must be made within 24 hours of delivery. Claims not received within 24 hours are waived by Buyer. Delivery to job site constitutes delivery to Buyer regardless of whether Buyer or his/her agent is at the site at the time of delivery or signs a delivery receipt. In those rare instances when a package is lost or an item is damaged in transit, we assume full responsibility for filling claims. For accuracy of your order and damaged goods follow these simple steps:
- A. Count quantity of items and ensure that it matches amount on invoice. If not, sign invoice short before the driver leaves. Any visible signs of packaging being torn should be noted on invoice.
- B. Check in shipment and repot discrepancies immediately. Shortages will not be allowed if not reported within 24 hours of receipt of goods.
- C. If a shortage has been filed, but later received, please notify us immediately so paperwork could be corrected.
Limitation on Liability
In no event shall Hardware & Apartment Supply Co., Inc. or its respective affiliates have any liability for consequential damages, including lost profits, or lost good will, incidental damages, special damages, more damages, indirect damages, punitive damages, liquidated damages, exemplary damages, or any other form of damages arising out of the product or goods sold in this catalog, even if advised of the possibility of these types of damages, whether such damages are alleged in tort, contract or otherwise.
Governing Law and Venue
With regard to any claim, suit or action related to the purchase of the products or goods in this catalog, the rights and obligations of the parties shall be governed by and interpreted in accordance with the laws of the state of California, without regard to its conflicts of laws principles. Any and all disputes arising hereunder or otherwise relating to the products or goods in this catalog shall be brought exclusively before the state of federal courts of Los Angeles County, California.
Limited Warranty
Goods or products not manufactured by Seller are warranted and guaranteed only to the extent and in the manner warranted and guaranteed to purchaser by the original manufacturer of such goods or products.

Products that comply with the strict lead-free standards of California are designated by an "LF” at the end of the item number or by the word “Lead-Free” in the table or description. Since we are continually adding more lead-free products, please call our Customer Service team if you do not see what you need.
Limited Lifetime Warranty
ROC®, Premier®, and Proplus® brand items are warranted against defects in materials or workmanship, for the lifetime of the original purchaser (excluding commercial faucets, non-metallic faucets, all RoC® Proplus® faucets, Premier and Today's Design House ® vanities and vessel sinks. Defective products will be repaired or (at the option of manufacturer and as its sale warranty option) replaced free of charge when returned with proof of purchase to the manufacturer. Hardware & Apartment Supply Co., Inc. will in no event be responsible for any damages for loss of use of defective products, for damages caused to other tangible property by defective products, or for other consequential or incidental damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state.
